Realty cheating case: Delhi High Court stays trial court’s order for fresh probe against Gautam Gambhir

The Delhi High Court postponed a lower court’s decision to dismiss former cricket player Gautam Gambhir in a case involving accused homebuyer fraud. The former Indian cricket player was cleared of all charges despite serving as the director and brand ambassador for a real estate company involved in the case. That order had been contested by the state administration.

In a case where homebuyers were allegedly defrauded, the Delhi High Court on Monday delayed an order that had overturned the dismissal of Gautam Gambhir, the current head coach of the Indian cricket team and a former cricket player. In response to Gambhir’s plea contesting the sessions court decision that overturned a magistrate court ruling dismissing him from the case, Justice Manoj Kumar Ohri issued the interim order and requested the Delhi government’s answer. In support of Gambhir, Senior Advocate Mukul Rohatgi emphasised his spotless record and the possibility of harassment from additional research.

The high court stated that a more thorough order would be issued later.

On October 29, the sessions court declared that the magisterial court’s ruling in dismissing the charges against Gambhir demonstrated “inadequate expression of mind.”

“The claims also warrant a more thorough investigation into Gautam Gambhir’s involvement,” it stated.

The case was remanded to the magistratal court by the sessions court, with instructions to issue a comprehensive new order. The real estate companies Rudra Buildwell Realty Pvt Ltd, H R Infracity Pvt Ltd, U M Architectures and Contractors Ltd, and Gambhir, a director and brand ambassador of the joint venture, were all named in the cheating case.
